Please read these terms carefully before using VidGift

By accessing or using VidGift ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
VidGift provides a platform that enables users to:
- Create collaborative video gifts for special occasions
- Invite friends and family to contribute video messages, photos, and text
- Compile contributions into a single, memorable video gift
- Share and deliver video gifts to recipients
The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
3.1 Account Creation
To use certain features of VidGift, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Notify us immediately of any unauthorized account access
- Be responsible for all activities under your account
3.2 Account Eligibility
You must be at least 13 years old to create an account. Users under 18 must have parental consent to use the Service.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion.
4.1 Your Content
You retain ownership of any content you upload to VidGift, including videos, photos, and text. By uploading content, you grant VidGift a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content solely for the purpose of providing and improving the Service.
4.2 Prohibited Content
You agree not to upload or share content that:
- Is illegal, harmful, threatening, abusive, or defamatory
- Infringes on intellectual property rights of others
- Contains viruses, malware, or harmful code
- Is sexually explicit or pornographic
- Promotes violence, discrimination, or hatred
- Violates any applicable laws or regulations
4.3 Content Moderation
We reserve the right to review, remove, or refuse any content that violates these Terms or that we deem inappropriate at our sole discretion.
The Service and its original content (excluding user-generated content), features, and functionality are owned by VidGift and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Our trademarks, logos, and service marks may not be used without our prior written consent.
6.1 Pricing
Certain features of VidGift require payment. All prices are displayed in USD and are subject to change with notice. Current pricing is available on our website.
6.2 Payment Processing
Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms and conditions.
6.3 Refunds
Refunds are provided at our discretion. Please contact us at support@vidgift.ca within 7 days of purchase to request a refund.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDGIFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO VIDGIFT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
You agree to indemnify and hold harmless VidGift, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your content uploaded to the Service
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through a notice on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
